How is overtime calculated in Kentucky?

Kentucky follows the federal FLSA rule of time-and-a-half for hours worked beyond 40 in a workweek, and has no daily overtime threshold. Kentucky adds one rule the FLSA does not have: under KRS 337.050, an employee who works all seven days of a workweek must be paid time-and-a-half for the hours worked on that seventh day, even if the week totals fewer than 40 hours. An employer may credit that seventh-day premium against overtime already owed for hours over 40, so the two do not stack.

How is Kentucky overtime pay calculated in 2026?

Kentucky has no daily overtime rule - the trigger is more than 40 hours in a workweek, not more than 8 in a day.

KRS 337.050 requires time-and-a-half on the seventh consecutive day of a workweek, which federal law does not.

The seventh-day premium can be credited against overtime already owed for the same week, so an employer does not pay both.

Overtime is ordinary wages: Kentucky's 3.5% flat tax, FICA, and the local occupational tax all apply to it at the normal rates.
